Each facility is assigned a DEQ AQ staff member for handling compliance questions and reporting reviews. In CERIS-ND, under Permits> Agency Contact you will see your DEQ AQ permit manager and under Submissions you will see your DEQ AQ compliance manager.

Notifications, reports, etc. can be submitted through CERIS-ND for your site(s) using the
Submissions> Air Part 60 NSPS Compliance Report, Air Part 61 NESHAPS Compliance Report, or Air Part 63 MACT/GACT Compliance Report.
Note: Some specific reports have their own forms, see list on our CERIS-ND page for reports available for electronic submission. Emissions testing and RATAs required for any reason (permit or federal rule) have their own electronic forms (see our Testing page).

Required notifications, reports, etc. should be submitted through CERIS-ND for the site(s) that are submitting.

Pro tip: If you have an active Operating Permit, filter the available forms by "AOP" (air operating permit) in the list of schedules to submit the compliance report or testing report tied to the active permit to operate. If you are submitting an initial testing report or initial notification required by a Permit to Construct (ACP) then find the ACP permit number for your preconstruction permit and submit using that schedule form.

Annual Emission Inventory Reports (AEIR)

At the beginning of each year, the Department will send letters to the company AEIR contact person responsible for submitting emission inventory reports. The reports will address operations during the previous year (January 1-December 31) and are due by March 15 unless a later date is specified in the permit.

Annual Production Reports are included in the AEIR reporting program.

Emission data are used to determine compliance with regard to emission limits and/or permit conditions; to identify emission levels, patterns, and trends; to serve as the basis for modeling of predicted pollutant concentrations in ambient air; to provide input for human health risk assessment studies; and to serve as a basis for determining annual permit-to-operate fees.

Emission inventories should be as accurate and complete as possible. Emission data should be included for each significant unit/activity listed on the Air Pollution Control Permit to Operate for the installation. The following methodologies can be used to determine emissions:

• Material (mass) balance

State and Local Emission Inventory System (SLEIS)

The Division of Air Quality utilizes the State and Local Emissions Inventory System (SLEIS) to submit, review, and process annual emissions inventory reports (AEIRs). This system allows facilities to edit and submit their AEIR electronically, view Department changes, and view their annual fee. This system is used exclusively by all facilities holding a Title V, Synthetic Minor or Minor source permit that are required to submit an AEIR.

SLEIS Account Access Instructions:

• Title V Sources - Complete the Subscriber Agreement (SFN 61755) and mail it to the Department. Please allow two weeks for processing and account activation. You will receive an email from DEQ-SLEIS@nd.gov when your account has been activated.


• Subscriber Agreement forms that are submitted that do not contain the "wet" signature (e.g. photocopied, faxed or scanned and emailed) or are incomplete will not be processed.

• Minor and Synthetic Minor Sources - Email the information below to the facility's Department compliance contact. If unknown, email the information to DEQ-SLEIS@nd.gov. You will receive an email from DEQ-SLEIS@nd.gov when your account has been activated.

Exemptions:

• The rules exempt state and local government-owned facilities from fees.
• Small Businesses under the Clean Air Act may petition for exemption from annual fees. For more information about small businesses see the Small Business Assistance Program.

Each boiler with a heat input greater than 250 MMBtu/hr will be assessed fees on an individual basis and independent of the fees associated with the rest of the installation.

Major source fee rate/ton may be increased annually based on 12-month Consumer Price Index (CPI) ending August 31 each year. Note: The August 2025 12-month CPI rate was +2.9%.
